Common use of Payment of Rent to Court Clause in Contracts

Payment of Rent to Court. In any legal action by Lessor for possession of the Premises, if Lessee raises any defense other than payment, Lessee must pay into the registry of the court the past due rent set forth in Lessor’s complaint, or an amount determined by the court, and the rent which comes due during the lawsuit, as it comes due. Failure of Lessee to pay the rent into the registry of the court will be a waiver of Lessee’s defenses other than payment.
