PAYMENT OF RENTAL AND OTHER SUMS. All rental and other sums which Lessee is required to pay hereunder shall be the unconditional obligation of Lessee and shall be payable in full when due without any setoff, abatement, deferment, deduction or counterclaim whatsoever. Upon execution of this Lease, Lessee shall establish arrangements whereby payments of the Base Monthly Rental and impound payments, if any, are transferred by Automated Clearing House Debit directly from Lessee's bank account to such account as Lessor may designate. Any delinquent payment (that is, any payment not made within five calendar days after the date when due) shall, in addition to any other remedy of Lessor, incur a late charge of 5% (which late charge is intended to compensate Lessor for the cost of handling and processing such delinquent payment and should not be considered interest) and bear interest at the Default Rate, such interest to be computed from and including the date such payment was due through and including the date of the payment; provided, however, in no event shall Lessee be obligated to pay a sum of late charge and interest higher than the maximum legal rate then in effect and in no event shall Lessee be obligated to pay a late charge for delinquent payments which arise solely from Lessor or Lender failing to initiate the applicable Automated Clearing House Debit.

Any delinquent payment (that is, any payment not made within five calendar days after the date when due) shall, in addition to any other remedy of Lessor, incur a late charge of 5% (which late charge is intended to compensate Lessor for the cost of handling and processing such delinquent payment and should not be considered interest) and bear interest at the Default Rate, such interest to be computed from and including the date such payment was due through and including the date of the payment; provided, however, in no event shall Lessee be obligated to pay a sum of late charge and interest higher than the maximum legal rate then in effect and in no event shall Lessee be obligated to pay a late charge for delinquent payments which arise solely from Lessor or Lender failing to initiate the applicable Automated Clearing House Debiteffect.

Any delinquent payment (that is, any payment not made within five calendar days after the date when due) shall, in addition to any other remedy of Lessor, incur a late charge of 5% (which late charge is intended to compensate Lessor for the cost of handling and SCS Finance I, L.P. processing such delinquent payment and should not be considered interest) and bear interest at the Default Rate, such interest to be computed from and including the date such payment was due through and including the date of the payment; provided, however, in no event shall Lessee be obligated to pay a sum of late charge and interest higher than the maximum legal rate then in effect and in no event shall Lessee be obligated to pay a late charge for delinquent payments which arise solely from Lessor or Lender failing to initiate the applicable Automated Clearing House Debiteffect.

Any delinquent payment (that is, any payment not made within five calendar days after the date when due) shall, in addition to any other remedy of Lessor, incur a late charge of 510% (which late charge is intended to compensate Lessor for the cost of handling and processing such delinquent payment and should not be considered interest) and bear interest at the Default Rate, such interest to be computed from and including the date such payment was due through and including the date of the payment; provided, however, in no event shall Lessee be obligated to pay a sum of late charge and interest higher than the maximum legal rate then in effect and in no event shall Lessee be obligated to pay a late charge for delinquent payments which arise solely from Lessor or Lender failing to initiate the applicable Automated Clearing House Debiteffect.

Any delinquent payment (that is, any payment not made within five calendar days after the date when due) shall, in addition to any other remedy of Lessor, incur a late charge of 5% (which late charge is intended to compensate Lessor for the cost of handling and processing such delinquent payment and should not be considered interest) and bear interest at the Default Rate, such interest to be computed from and including the date such payment was due through and including the date of the payment; provided, however, in no event shall Lessee be obligated to pay a sum of late charge and interest higher than the maximum legal rate then in effect and in no event shall Lessee be obligated to pay a late charge for delinquent payments which arise solely from Lessor or Lender failing to initiate the applicable Automated Clearing House Debiteffect.

Any delinquent payment (that is, any payment not made within five calendar days after the date when due) shall, in addition to any other remedy of Lessor, incur a late charge of 5% (which late charge is intended to compensate Lessor for the cost of handling and processing such delinquent payment and should not be considered interest) and bear interest at the Default Rate, such interest to be computed from and including the date such payment was due through and including the date of the payment; provided, however, in no event shall Lessee be obligated to pay a sum of late charge and interest higher than the maximum legal rate then in effect and in no event shall Lessee be obligated to pay a late charge for delinquent payments which arise solely from Lessor or Lender failing to initiate the applicable Automated Clearing House Debiteffect.

Upon execution of this Lease, Lessee shall establish arrangements whereby payments of the Base Monthly Rental and impound payments, if any, are transferred due to Lessor from Lessee shall be paid to Lessor (at its election from time to time) in one of the following manners: (a) by Automated Clearing House Debit directly from electronic deposit into an account designated by Lessor, (b) by mail at Lessor’s address set forth in Section 29, or (c) by mail to any other place in the United States designated by Lessor upon at least thirty (30) days’ prior written notice to Lessee's bank account to such account as Lessor may designate. , Any delinquent payment (that is, any payment not made within five calendar days after the date when due) shall, in addition to any other remedy of Lessor, incur a late charge of 52% (which late charge is intended to compensate Lessor for the cost of handling and processing such delinquent payment and should not be considered interest) and bear interest at the Default Rate, such interest to be computed from and including the date such payment was due through and including the date of the payment; provided, however, in no event shall Lessee be obligated to pay a sum of late charge and interest higher than the maximum legal rate then in effect and in no event shall Lessee be obligated to pay a late charge for delinquent payments which arise solely from Lessor or Lender failing to initiate the applicable Automated Clearing House Debiteffect.

Upon execution of this Lease, Lessee shall authorize Lessor to establish arrangements whereby payments of the Base Monthly Rental, any Additional Rental and impound payments, if any, are transferred by Automated Clearing House Debit initiated by Lessor or its designee directly from Lessee's an account at a U.S. bank account in the name of Lessee to such account as Lessor may designatedesignate provided, however, upon notice from any Lender, co-signed by Lessor, delivered in the manner set forth in Section 27, Lessee shall deliver all payments of Base Monthly Rental and Additional Rental as specified in such notice. Any delinquent payment (that is, any payment not made within five (5) calendar days after the date when duedue and after the date of Lessee’s receipt of Lessor’s written notice relating thereto) shall, in addition to any other remedy of Lessor, incur a late charge of 5% (which late charge is intended to compensate Lessor for the cost of handling and processing such delinquent payment and should not be considered interest) and bear interest at the Default Rate, such interest to be computed from and including the date such payment was due through and including the date of the payment; provided, however, in no event shall Lessee be obligated to pay a sum of late charge and interest higher than the maximum legal rate then in effect and in no event shall Lessee be obligated to pay a late charge for delinquent payments which arise solely from Lessor or Lender failing to initiate the applicable Automated Clearing House Debiteffect.
