Common use of Payment of the Credit Enhancement Draw Amount Clause in Contracts

Payment of the Credit Enhancement Draw Amount. The Indenture Trustee will make payments to the related Class of Noteholders from the Credit Enhancement Draw Amount (but not including any portion of it representing a Preference Claim) drawn under the Policy for any Payment Date and Class pursuant to Section 8.05 on the Payment Date as follows: FIRST, as an addition to the amount distributed pursuant to Section 8.03(a)(ii); and SECOND, the portion of the Credit Enhancement Draw Amount remaining after the application of the amounts referred to in First above, as an addition to the amounts distributed pursuant to Section 8.03(b). The aggregate amount of principal distributed to the Holders of either Class of Notes under this Indenture shall not exceed the related Original Note Principal Balance.
