Payment on termination for Default. 34.6.1 If the this Agreement is terminated under clauses 34.3, 34.4 or 34.5 the provisions of paragraph 2 of Schedule 19 (Exclusion and Termination) shall apply and, subject to the Owner’s rights under or in connection with this Agreement: 34.6.1.1 the Owner must pay each NOP; or 34.6.1.2 each NOP must pay the Owner. (as the case may be), an amount calculated or decided under paragraph 2 of Schedule 19 (Exclusion and Termination).
