Common use of Payment; Security Deposit Clause in Contracts

Payment; Security Deposit. Any obligation (a) to pay Tenant any sum(s) that any Former Landlord owed to Tenant, or (b) with respect to any security deposited with Former Landlord, unless such security was actually delivered to Mortgagee. This Section is not intended to apply to Landlord’s obligation to make any payment that constitutes a Construction-Related Obligation.

Any obligation obligation: (a) to pay Tenant any sum(s) that any Former Landlord owed to Tenant, Tenant or (b) with respect to any security deposited with Former Landlord, unless such security was actually delivered to Mortgagee. This Section paragraph is not intended to apply to Landlordto, or impair or limit, ▇▇▇▇▇▇▇▇’s obligation to make any payment that constitutes a Construction-Related Obligation; provided, however, that Tenant’s continued payment of Rent shall be conditioned on such obligations being performed and discharged and subject to any applicable Offset Right.
