Common use of Payments and Modifications of Subordinated Indebtedness Clause in Contracts

Payments and Modifications of Subordinated Indebtedness. (a) Amend, modify, waive or supplement (or permit the modification, amendment, waiver or supplement of) any of the terms or provisions of any Subordinated Indebtedness in any respect which would materially and adversely affect the rights or interests of the Lender hereunder or would violate the subordination terms thereof.

Payments and Modifications of Subordinated Indebtedness. (a) Prepay, redeem, repurchase or otherwise acquire for value any Subordinated Indebtedness, or make any principal, interest, or other payments on any Subordinated Indebtedness, in each case, other than as expressly permitted by the Subordination Agreement applicable thereto. (b) Amend, modify, waive or supplement (change in any manner any term or permit the modification, amendment, waiver or supplement of) any of the terms or provisions condition of any Subordinated Indebtedness in any respect which would materially and adversely affect Documents other than as permitted by the rights or interests of the Lender hereunder or would violate the subordination terms thereofSubordination Agreement applicable thereto.
