Common use of Payments by the State Clause in Contracts

Payments by the State. The State of Florida’s performance and obligation to pay under this ACS is contingent upon an annual appropriation by the Legislature. Payment shall be made in accordance with section 215.422, Florida Statutes. Interest penalties for late payment are available subject to the provisions in section 215.422, Florida Statutes.
