Common use of Payments Final Clause in Contracts

Payments Final. Each payment of Basic Rent, Additional Rent and any other amount due hereunder made by Lessee shall be final, and Lessee, without waiving any other remedies it may have, will not seek or have any right to recover all or any part of such payment from Brazos or any Assignee for any reason whatsoever, except as expressly provided herein. The making of payments under this Ground Lease by Lessee (including payments pursuant to ARTICLE X) shall not be deemed to be a waiver of any claim or claims that Lessee may assert against Brazos or any other person. Brazos agrees to repay Lessee amounts paid to Brazos to the extent such payments were in error and are not required by the various terms and provisions of this Ground Lease.
