Common use of Payments Pending Litigation and/or Arbitration Clause in Contracts

Payments Pending Litigation and/or Arbitration. In the case of a Qualifying Termination other than during a Protection Period, upon the material violation of any of the provisions of this Agreement or a dispute regarding the subject matter of this Agreement, Company shall cease payment of all Severance Pay and severance benefits pending the outcome of litigation and/or arbitration on such issues pursuant to this Article III. In the case of a Qualifying Termination during a Protection Period, upon the material violation of any of the provisions of this Agreement or a dispute regarding the subject matter of this Agreement, Company shall continue payment of all Severance Pay and severance benefits pending the outcome of litigation and/or arbitration pursuant to this Article III, subject to being reimbursed if so ordered in any such litigation or arbitration.
