Common use of PAYMENTS TO THE EMPLOYER Clause in Contracts

PAYMENTS TO THE EMPLOYER. Except as provided in Section 2(c) and 3 hereof, the Employer shall have no right or power to direct the Trustee to return to the Employer or to divert to others any of the Trust assets before all benefit payments have been made to Plan participants and their beneficiaries pursuant to the terms of the Plan.

PAYMENTS TO THE EMPLOYER. Except as provided in Section 1(a), 2(c), 2(d), 3 or 5(c) and 3 hereof, the Employer shall have no right or power to direct the Trustee to return to the Employer or to divert to others any of the Trust assets before all benefit Account-Based Benefits payments have been made to Plan participants and their the Executive or his beneficiaries pursuant to the terms of the PlanEmployment Agreement.
