Payroll Inspection. 1. The Union shall have the right to inspect the paycheck of any employee covered by this Agreement after a paycheck has been returned by the bank or payments are improper to the employee.
2. The Employer shall provide the Union all payroll records and documents related to any employee covered by this Agreement. In the event the results of such inspection or audit reveal that the Employer has violated any term or condition of this Agreement, the Employer shall be liable for the costs of such audit, including legal or accounting fees. If, however, the Employer can establish that said violations were not intentional, the Employer shall not be liable for the costs of such audit, including legal and accounting fees.

After scheduling an appointment with the business manager, the Union shall have the right to examine time sheets or any other appropriate record of the Employer pertaining to the computation of compensation of any employee whose pay is in dispute. Such inspection shall be conducted in the presence of the business manager/designee during business hours and at/near the place where the Employer customarily maintains business records.

The Union shall have the right, when it deems there is a violation of this Agreement, to check the Local No. 313 bargaining unit payroll records in regard to wages, pension, health and welfare or any other cost of fringe items, including overtime pay. If the Employer refuses, the Union is free to take any economic action against such Employer it deems necessary, and such action shall not be considered a violation of this Agreement.

If a complaint is made concerning the amount of wages received or paid to an EMPLOYEE for work performed under this contract, the Business Representative with the president of the COUNCIL or the Shop ▇▇▇▇▇▇▇ or an International Representative shall have the right to inspect the EMPLOYER’S payroll relative to the EMPLOYEE or EMPLOYEES involved.
