Penalties for Delinquent Payment of Contributions and/or Deductions. The Union will advise the Employer in writing of any delinquency contribution or deductions required to be made pursuant to this Agreement. There shall be a fifteen percent (15%) penalty of the amount of the late payment or error in remittance and the Union shall be free to withdraw its members from the Employer without contravening the terms of this Agreement. The amount of the penalty to go to the appropriate fund. The Employer shall have forty-eight (48) hours following receipt of notification, exclusive of Saturday, Sunday and Statutory Holidays, in which to respond in the event of an error in remittance. No grace period shall be granted in the event of a late payment.
