Common use of Pending Litigation or Proceedings Clause in Contracts

Pending Litigation or Proceedings. Except as set forth on Schedule 6.6 attached hereto, there are no judgments outstanding or actions, suits or proceedings pending or, to the best of Borrower’s knowledge, threatened against or affecting Borrower, at law or in equity or before or by any federal, state, municipal or other governmental department, commission, board, bureau, agency or instrumentality, domestic or foreign which could reasonably be expected to result in a Material Adverse Effect.

Pending Litigation or Proceedings. Except as set forth on Schedule 6.6 7.6 attached hereto, there are no judgments outstanding or actions, suits or proceedings pending or, to the best of Borrower’s Borrowers' knowledge, threatened against or affecting Borrower, any Borrower at law or in equity or before or by any federal, state, municipal or other governmental department, commission, board, bureau, agency or instrumentality, domestic or foreign which could reasonably be expected to result in a Material Adverse Effectforeign.
