Pennsylvania Mining Complex[Reserved]. Prior to the consummation of the Take-In Transaction, the Borrower shall not, and shall not cause or permit any Subsidiary to, use the Pennsylvania Mining Complex in the production, transmission, or distribution, for sale, of electric energy or of natural or synthetic gas for heat, light, or power within the meaning of Section 363(h)(4) of the Bankruptcy Code.
