Common use of Pension and Benefit Plans Clause in Contracts

Pension and Benefit Plans. (i) Neither Seller nor any ERISA Affiliate has, for the prior six (6) years, ever maintained, established, sponsored, participated in, contributed to, or had, for the prior six (6) years, or could have any obligation to, any (A) Pension Plan which is subject to Part 3 of Subtitle B of Title I of ERISA, Title IV of ERISA or Section 412 of the Code, (B) multiple employer plan or to any plan described in Section 413 of the Code, or (C) Multiemployer Plan;

(i1) Neither Seller nor any ERISA Affiliate has, for in the prior six last five (65) years, ever maintained, established, sponsored, participated in, contributed to, or had, for the prior six (6) years, had or could have any obligation to, any (A) Pension Plan which is subject to Part 3 of Subtitle B of Title I of ERISA, Title IV of ERISA or Section 412 of the Code, or (B) multiple employer plan or to any plan described in Section 413 of the Code, or (C) Multiemployer Plan;.
