Performance and Compliance with Contracts and Credit and Collection Policy. The Borrower will, at its expense, (i) timely and fully perform and comply in all material respects with all provisions, covenants and other promises (if any) required to be observed by it under the Contracts related to the Pool Receivables in the same manner as if this Agreement did not exist and (ii) timely and fully comply in all material respects with the Credit and Collection Policy (as amended from time to time in accordance with the terms hereof).
