Performance by OneNeck’s Affiliates Clause Samples

Performance by OneNeck’s Affiliates. Client understands that actual performance of the Services may be made by the divisions, subsidiaries and/or Affiliates of OneNeck and that OneNeck has the right from time to time to subcontract certain of the Services to third party providers. However, at no time shall OneNeck subcontract a material portion of the Services. For purposes of this Agreement, performance of the Services by any division, subsidiary and/or Affiliate of OneNeck or by any such subcontractors shall be deemed performance by OneNeck itself.
