Common use of Performance by Transferee Clause in Contracts

Performance by Transferee. The Transferee must perform all of the Required Obligations under the Original Agreement as if named as the Transferor, whether or not the relevant obligations relate to works performed prior to the date of this Deed, including, but not limited to: (a) the delivery of all relevant public benefits to Council (including the Contribution Amounts, Contribution Lands and Contribution Works); and (b) the provision of all relevant Guarantees to Council.
