Performance during Dispute and Claim Resolution Process. The Developer shall diligently proceed with Work on the Project at the same time that Disputes and Claims are addressed under this Article. It is the intent of District to resolve Disputes with the Developer as close to the events giving rise to the Disputes as possible, and to avoid stale or late Claims and the late documenting of Claims. Developer’s failure to diligently proceed in accordance with the District’s instructions will be considered a material breach of this Agreement.
