Performance Metrics. The “Performance Metrics” for the Performance Period are: (i) the JD Power Residential National Large Segment Survey for investor-owned utilities; (ii) the System Average Interruption Frequency Index (Major Events Excluded) (“XXXXX”); (iii) Arizona Public Service Company’s customer to employee improvement ratio; (iv) the OSHA rate (All Incident Injury Rate); (v) nuclear capacity factor; and (vi) coal capacity factor.
(1) With respect to the Performance Metric described in clause (i) of this Subsection 6(a), the JD Power Residential National Large Segment Survey will provide data on an annual basis reflecting the Company’s percentile ranking, relative to other participating companies.
(2) With respect to the Performance Metric described in clause (ii) of this Subsection 6(a), the Edison Electric Institute (“EEI”) will provide data on an annual basis regarding the XXXXX result of the participating companies; the Company will calculate its XXXXX result for the year in question and determine its percentile ranking based on the information provided by EEI.
(3) With respect to the Performance Metric described in clause (iii) of this Subsection 6(a), SNL, an independent third party data system, will provide data on an annual basis regarding the customer and employee counts; the Company will use its customer and employee counts for the year in question and determine its percentile ranking based on the information provided by SNL. Only those companies whose customers and employees were included in the data provided by SNL in each of the years of the Performance Period will be considered.
(4) With respect to the Performance Metric described in clause (iv) of this Subsection 6(a), EEI will provide data on an annual basis regarding the OSHA rate of the participating companies; the Company will calculate its OSHA rate for the year in question and determine its percentile ranking based on the information provided by EEI.
(5) With respect to the Performance Metric described in clause (v) of this Subsection 6(a), SNL will provide data on an annual basis regarding the nuclear capacity factors of the participating nuclear plants; the Company will calculate its nuclear capacity factor for the year in question and determine its percentile ranking based on the information provided by SNL. Only those plants that were included in the data provided by SNL in each of the years of the Performance Period will be considered.

Performance Metrics. You shall not disclose or publish, without prior written consent from UPS, any performance or capacity statistics related to or the results of any benchmark test performed on the UPS Technology.
Performance Metrics. The State has developed a set of performance metrics and targets, defined in Section 1 (C) – Pre-Season Meeting(s), Section 1 (D) – Bi-Weekly Calls, Section 1 (E) – Reporting, Section 1 (G) – Timely Responses to Inquiry, Exhibit B – INDOT & Other State Agencies Specifications, and Exhibit C – Local Governmental Entities Specifications, which the Contractor shall meet or exceed in order to be in good standing on the contract. The performance for the metrics referenced in Section 1 (C) – Pre- Season Meeting(s), Section 1 (D) – Bi-Weekly Calls, Section 1 (E) – Reporting, Section 1 (G) – Timely Responses to Inquiry and invoice credits shall be reviewed quarterly by the State Contract Manager and can be discussed via quarterly conference call or via email. Invoice Credits will only be applied to Pre-Season Meeting(s), Bi-Weekly Calls, Reporting or Timely Response non-compliance issues. Deductions resulting from non-compliance of the Scopes of Work listed in Exhibit B – INDOT & Other State Agencies Specifications and Exhibit C – Local Governmental Entities Specifications are detailed in these documents and will be applied by the purchasing entity per the guidelines and timeframes set forth in these documents.
Performance Metrics. Company represents and warrants that: (i) it will, with respect to any services, meet all of and comply with the performance metrics set forth herein; and (ii) with respect to Products, the Products will function in accordance with and comply with and meet all of the performance metrics set forth herein. Performance Metrics. The State has developed a set of performance metrics and targets, defined below, that the Contractor shall meet or exceed in order to be in good standing on the contract. The performance for these metrics and invoice credits shall be reviewed quarterly by the State Contract Manager at each Quarterly Business Review.
Performance Metrics. Contractor, to retain the Participating Addendum, annually must achieve the performance-based metrics specified below. Enterprise Services, on annual basis, no later than 9 months after Participating Addendum execution date, will evaluate Contractor’s performance to ensure that Contractor meets the contractual performance requirements. If Enterprise Services determines that Contractor is in compliance with the performance requirements set forth in this Participating Addendum, the Participating Addendum will continue in effect for another year up and until the end of the Participating Addendum term. If, however, Contractor does not satisfy the performance requirements, Enterprise Services will notify Contractor in writing and identify steps to meet the identified performance requirements. If Contractor does not comply with the mitigation requirements set forth in the notification, Enterprise Services reserves the right to cancel the Participating Addendum as set forth in Section 14.6 of the Master Agreement. Contractor may be prohibited from providing goods and services under this Participating Addendum during any corrective action period. In order to satisfactorily pass the annual performance assessment and maintain this Participating Addendum, Contractor must achieve the following performance-based metrics: Performance Metric Performance Requirement Contractor Representations and Warranties: Maintain 100% compliance with all representations and warranties as listed in Section 3.5 of this Participating Addendum. Certificate of Insurance(COI): Provide to Enterprise Services without exception, annual insurance endorsements (COI) as submitted for the NASPO ValuePoint Security and Fire Protection Services Master Agreement.
Performance Metrics. Collect data including: (a) ratio of annual Assessment amount to total annual Budget; (b) all net gains and losses in businesses; (c) all net gains and losses in jobs; (d) ground floor vacancy rate; and (e) average rental rate per square foot. This requirement may change annually. Review the Operating Manual for any changes.
Performance Metrics. In the event that both of the following performance metrics (the “Performance Metrics”) are not achieved, then in accordance with Section 8.4 below Grantee shall upon written demand by Triumph repay to Triumph all portions of Grant theretofore disbursed to and received by Grantee:
(a) Performance Metric #1: By the date (the “Performance Commencement Date”) which is three (3) years after the earlier to occur of (i) the date that the construction of the Project has been substantially completed as evidenced by the issuance of a certificate of occupancy for an industrial building constructed within the Property, or (ii) five (5) years from the date of execution of this Agreement, the Project will have (a) created at least 454 New Jobs (as defined below), and (b) Grantee shall have obtained Matching Funds from private sector occupants in the Park totaling not less than $21,000,000 used exclusively toward completion of the Project as shown in the Budget; and
(b) Performance Metric #2: All of the 454 New Jobs shall have been maintained for at least three (3) years after the Performance Commencement Date. As used herein, a “New Job” shall mean a job within the Park that (a) has an average wage of not less than $41,770, (b) was created after the date of this Agreement, (c) could not be sustained absent the availability of the Park, and (d) is performed by a full-time employee or a full-time equivalent employee working at least 35 paid hours per week. Jobs are not considered New Jobs if they are (A) moved from one business to another business within the Park, unless the relocated positions are back-filled with net new- to-Florida full-time-equivalent jobs paying at least the wage of the transferred position(s), (B) moved from one business unit or location of a business or any of its affiliates or subsidiaries in Florida to another business unit or location of that business or any of its affiliates or subsidiaries in Florida, unless the relocated positions are back-filled with net new-to- Florida full-time-equivalent jobs paying at least the wage of the transferred position(s); or (C) temporary construction jobs involved with the construction of the Project, or temporary or seasonal jobs associated with cyclical business activities or to substitute for permanent employees on a leave of absence. Performance Metrics. Grantee shall award a cumulative total of at least 225 Net New Certificates by the Completion Deadline (the “Performance Metrics”). In the event Grantee fails to award a cumulative total of at least 225 Net New Certificates by the Completion Deadline, then Grantee shall upon written demand by Triumph repay to Triumph an amount equal to (A) $2,743, multiplied by (B) the sum of (a) 225, minus (b) the actual number of Net New Certificates awarded as of the Completion Deadline. At any time and from time to time, upon written request by Triumph, Grantee shall within thirty (30) days of such request, deliver to Triumph such data, reports, payroll ledgers, state and federal payroll returns, financial statements and reporting, and other documents, instruments, and information, as well as its State of Florida employment reporting forms (collectively, “Back- up Data”) as Triumph requires in order to determine whether Grantee achieved of any or all of the above Performance Metrics. Xxxxxxx’s refusal or failure to timely provide any requested Back- up Data shall be deemed Xxxxxxx’s failure to timely achieve the above Performance Metrics. Notwithstanding the foregoing, so long as Grantee is making diligent efforts to obtain the Back- up Data from third parties, the thirty (30) day deadline described above shall be reasonably extended with respect to any Back-up Data needed to be obtained from third parties.
Performance Metrics. Municipality must ensure that the quality, progress, and nature of the Project strictly comply with the Performance Metrics stated in Exhibit C. The Contract Administrator may modify the Performance Metrics for the Project at any time with the written approval of the Project Manager. In addition to the reporting required pursuant to Section 6.1 above, Municipality shall provide written reports to the Contract Administrator on at least an annual basis, no later than ninety (90) days after the end of the fiscal year, documenting the Project’s compliance with the applicable Performance Metrics. The Contract Administrator or designee will provide technical assistance and support, as may be reasonably requested by Municipality, and shall make available to Municipality a centralized repository of relevant, available metrics and data.
