Performance Metrics. In the event Grantee fails to timely achieve the following performance metrics (the “Performance Metrics”), then in accordance with Section 8.4 below Grantee shall upon written demand by Triumph repay to Triumph all portions of Grant theretofore funded to and received by Grantee:

The “Performance Metrics” for the Performance Period are: (i) the System Average Interruption Frequency Index (Major Events Excluded) (“XXXXX”); (ii) Arizona Public Service Company’s customer to employee improvement ratio; (iii) the OSHA rate (All Incident Injury Rate); (iv) nuclear capacity factor; and (v) coal capacity factor.
Performance Metrics. You shall not disclose or publish, without prior written consent from UPS, any performance or capacity statistics related to or the results of any benchmark test performed on the UPS Technology.

The performance for the metrics referenced in Section 1 (C) – Pre- Season Meeting(s), Section 1 (D) – Bi-Weekly Calls, Section 1 (E) – Reporting, Section 1 (G) – Timely Responses to Inquiry and invoice credits shall be reviewed quarterly by the State Contract Manager and can be discussed via quarterly conference call or via email. Invoice Credits will only be applied to Pre-Season Meeting(s), Bi-Weekly Calls, Reporting or Timely Response non-compliance issues. Deductions resulting from non-compliance of the Scopes of Work listed in Exhibit B – INDOT & Other State Agencies Specifications and Exhibit C – Local Governmental Entities Specifications are detailed in these documents and will be applied by the purchasing entity per the guidelines and timeframes set forth in these documents.
Performance Metrics. The State has developed a set of performance metrics and targets, defined below, that the Contractor shall meet or exceed in order to be in good standing on the contract. The performance for these metrics and invoice credits shall be reviewed quarterly by the State Contract Manager at each Quarterly Business Review.
Performance Metrics. Collect data including: (a) ratio of annual Assessment amount to total annual Budget; (b) all net gains and losses in businesses; (c) all net gains and losses in jobs; (d) ground floor vacancy rate; and (e) average rental rate per square foot. This requirement may change annually. Review the Operating Manual for any changes.
Performance Metrics. Contractor, to retain the Participating Addendum, annually must achieve the performance-based metrics specified below. Enterprise Services, on annual basis, no later than 9 months after Participating Addendum execution date, will evaluate Contractor’s performance to ensure that Contractor meets the contractual performance requirements. If Enterprise Services determines that Contractor is in compliance with the performance requirements set forth in this Participating Addendum, the Participating Addendum will continue in effect for another year up and until the end of the Participating Addendum term. If, however, Contractor does not satisfy the performance requirements, Enterprise Services will notify Contractor in writing and identify steps to meet the identified performance requirements. If Contractor does not comply with the mitigation requirements set forth in the notification, Enterprise Services reserves the right to cancel the Participating Addendum as set forth in Section 14.6 of the Master Agreement. Contractor may be prohibited from providing goods and services under this Participating Addendum during any corrective action period. In order to satisfactorily pass the annual performance assessment and maintain this Participating Addendum, Contractor must achieve the following performance-based metrics: Performance Metric Performance Requirement Contractor Representations and Warranties: Maintain 100% compliance with all representations and warranties as listed in Section 3.5 of this Participating Addendum. Certificate of Insurance(COI): Provide to Enterprise Services without exception, annual insurance endorsements (COI) as submitted for the NASPO ValuePoint Security and Fire Protection Services Master Agreement.
Performance Metrics. This Section 3 sets for the percentage of Executive’s Target Bonus that will be earned based on the achievement of the Performance Goals set forth below.
Performance Metrics. Contractor agrees to meet the performance metrics established in Exhibit A, Statement of Work, during the Contract term.
