Common use of Performance of Borrower Assigned Agreements Clause in Contracts

Performance of Borrower Assigned Agreements. The Borrower shall (i) perform and observe in all material respects all the terms and provisions of the Transaction Documents (including each of the Borrower Assigned Agreements) to which it is a party to be performed or observed by it, maintain such Transaction Documents in full force and effect, and enforce such Transaction Documents in accordance with their terms, and (ii) upon reasonable request of the Facility Agent, make to any other party to such Transaction Documents such demands and requests for information and reports or for action as the Borrower is entitled to make thereunder.

The Borrower shall (i) perform and observe in all material respects all the terms and provisions of the Transaction Documents (including each of the Borrower Assigned Agreements) Agreements to which it is a party to be performed or observed by it, maintain such Transaction Documents agreements in full force and effect, and enforce such Transaction Documents agreements in accordance with their terms, to the extent that failure to do any of the foregoing could reasonably be expected to have a Material Adverse Effect, and (ii) upon reasonable request of the Facility Agent, make to any other party to such Transaction Documents agreements such demands and requests for information and reports or for action as the Borrower is entitled to make thereunder.
