Performance of Covenants, etc. Perform and observe all of its Contractual Obligations, including all such the covenants and agreements contained in the Project Contracts to which it is a party and shall enforce (including, as necessary, through negotiation, litigation or other reasonable means) the rights granted to it under and in connection with each of the Transaction Documents, except where the failure to perform and observe such Contractual Obligations or enforce such rights could not reasonably be expected to have a material adverse effect on any Portfolio Asset.
