Common use of Performance of Design Obligations Clause in Contracts

Performance of Design Obligations. (a) In the design and engineering of the Project, Project Co, its consultants and the Project Co Parties shall, at a minimum, exercise the standard of care normally exercised by licensed or registered professional architectural and engineering personnel having specialized knowledge and experience in performing design activities of a similar nature, scope and complexity.

Performance of Design Obligations. (a) In the design and engineering of the ProjectFacility, Project Co, its consultants and the Project Co Parties shall, at a minimum, exercise the standard of care normally exercised by licensed or registered professional architectural and engineering personnel having specialized knowledge and experience in performing design activities of a similar nature, scope and complexity.

(a) In the design and engineering of the ProjectSystem Infrastructure and New Municipal Infrastructure, Project Co, its consultants and the Project Co Parties shall, at a minimum, shall exercise the standard of care normally exercised by licensed or registered professional engineering and architectural personnel and engineering personnel other licensed or registered professionals, as applicable, having specialized knowledge and experience in performing design activities of a similar nature, scope and complexity.

(a) In the design and engineering of the ProjectBypass, Project Co, its consultants and the Project Co Parties shall, at a minimum, exercise the standard of care normally exercised by licensed or registered professional architectural and engineering personnel and other licensed or registered professionals, as applicable, having specialized knowledge and experience in performing design activities of a similar nature, scope and complexity.
