Common use of Performance of Obligations by Third Parties Clause in Contracts

Performance of Obligations by Third Parties. The NTO may arrange for one or more third parties to perform its responsibilities under this Agreement; provided, however, that the NTO shall require each such third party to agree in writing to comply with all applicable terms and conditions of this Agreement; provided, further, that in all cases the NTO shall be responsible for the acts and omissions of each such third party to the same extent as if such acts and omissions were made by the NTO or its employees, and such use of a third party shall not relieve the NTO of its responsibilities under this Agreement.
