Common use of Performance of Terms, Covenants and Conditions Clause in Contracts

All of the terms, covenants and conditions of this Agreement to be complied with or performed by the Subscriber on or before the Closing Date shall have been complied with or performed in all material respects on or before the times contemplated in this Agreement.
