Common use of Performance Representation Clause in Contracts

Performance Representation. 16.1 Consultant represents to County that Consultant has the skill and knowledge ordinarily possessed by well-informed members of its trade or profession practicing in the greater Houston metropolitan area and Consultant will apply that skill and knowledge with care and diligence to ensure that the Services provided hereunder will be performed and delivered in accordance with the local professional standard of care.

Consultant will apply that shall provide the Services to District with the same professional skill and knowledge with care ordinarily provided by such Professionals under the same or similar circumstances and diligence to ensure that professional license and as expeditiously as is prudent considering the Services provided hereunder will be performed ordinary professional skill and delivered in accordance with the local professional standard care of carea competent Professional.
