Performance Test Procedures. Contractor shall develop the Performance Test Procedures (for both the Five Consecutive Day Operational Test and the Five Day Performance Ratio Test) in accordance with Exhibit H and shall provide the Performance Test Procedures for Owner’s review and approval, as soon as reasonably practicable after Contractor’s receipt of the Notice to Proceed (but in no event later than sixty (60) days prior to the commencement of the first Performance to be conducted by Contractor hereunder). Owner shall have thirty (30) days from the date it receives the Performance Test Procedures to review and provide comments to Contractor. Contractor shall incorporate all of Owner’s reasonable comments into the final Performance Test Procedures, which shall be approved by Owner (such approval not to be unreasonably withheld). If Owner fails to provide its comments within such thirty (30) day period, then Owner shall be deemed to have approved the Performance Test Procedures. Contractor shall perform each Performance Test in accordance with the final approved Performance Test Procedures.
Performance Test Procedures. Each Performance Test shall be conducted in general accordance with [ASME Performance Test Code 46 for Combined Cycle facilities, ASME Performance Test Code 22 for simple cycle Gas Turbine facilities or ASME Performance Test Code 17 for Reciprocating Internal Combustion Engine facilities, depending on the technology of the Facility], and in accordance with the procedures set forth in subsections (i) through (xi) below, including additional procedures and protocols related to Performance Testing as mutually agreed between Buyer and Seller (“Test Procedures”).
(i) Meteorological equipment used for Performance Testing shall include the same equipment as specified in Section 3.7(f).
(ii) The Performance Test shall consist of six (6) one-half-hour test periods (the “Test Period”) at one hundred percent (100%) of Base Load with all turbines operating simultaneously [and six (6) one-half-hour test periods with all turbines operating simultaneously with duct firing “Peak Load”, if applicable]. [Language is for a combined cycle facility. For simple cycle facilities, test each turbine individually. For facilities other than simple cycle or combined cycle technology, specify the applicable test requirements. Facilities that have multiple operating modes may be subject to additional testing requirements as necessary to test the full range of capability of the Units.] For each one-half-hour test period, the data will be averaged and adjusted both to ISO Conditions as well as Peak July Conditions.
(iii) The Units shall be operated in steady state with all equipment in normal operating service.
(iv) The Energy output of the Units during the Performance Test shall be measured by the Electric Revenue Meter at the Electrical Delivery Point.
(v) The Capacity of a Unit as demonstrated by a Performance Test (“Tested Capacity”) shall be the metered Capacity, net of auxiliary loads and station use, of such Unit per hour (measured in megawatts), adjusted to ISO Conditions by using standard and accepted engineering methods. [Note: for Facilities with duct firing, the Tested Capacity is demonstrated up to Peak Load. For Facilities without duct firing, the Tested Capacity is demonstrated up to one hundred percent (100%)
Performance Test Procedures. The test procedures for each of the Performance Tests are set out in general detail in this Attachment S. Contractor shall, no later than one hundred eighty (180) Days prior to the scheduled date for commencement of Performance Tests for the first Unit (as shown by the then-current CPM Performance Measurement Baseline Schedule), submit to Owner for Owner’s comment and approval, proposed procedures, meeting the requirements set forth in this Attachment S, for each of the Performance Tests. Such proposed procedures shall include pre-test uncertainty calculations. Thereafter, the Parties shall meet and mutually agree upon written test procedures for all Performance Tests, and all such written test procedures shall be agreed upon at least ninety (90) Days prior to the commencement of any Performance Test.
Performance Test Procedures. Buyer and Seller shall mutually develop Test Procedures to verify the Project’s ability to accept Charging Energy, deliver Product, and operate according to the Operational Limitations specified in Appendix II. Each Performance Test will be conducted in general accordance with applicable CAISO Tariff requirements [and as applicable: ASME and other applicable Performance Test Codes, depending on the technology, Products, and Operational Limitations], and in accordance with the procedures set forth in subsections (i) through (vi) below, including additional procedures and protocols related to Performance Testing as mutually agreed between Buyer and Seller (“Test Procedures”).
(i) If test results are adjusted for ambient conditions, meteorological equipment used for Performance Testing will include the same equipment as specified in Section 7.6.
(ii) All measureable Product and Charging Energy during the Performance Test will be measured by the Electric Revenue Meter at the Electrical Delivery Point.
(iii) At a minimum, the Performance Test will test for the Dmax, Cmax, Storage Energy, Cmax Duration, Dmax Duration, Tested Duration Energy, and Full Duty Cycle.
(iv) Buyer may have a representative present at the Site at any time during a Performance Test, or alternatively, at Buyer’s request, Seller shall provide all necessary and requested test information to Buyer during the test without the need of a Buyer representative on Site. Buyer has the right to require Seller’s test engineer to be at the Site for the test.
(v) Buyer may not request Performance Testing be conducted during a Scheduled Maintenance Outage, Forced Outage or other Outage, provided that Seller has Notified Buyer of such Outage in accordance with Appendix III.
(vi) Seller shall prepare the Test Procedures based upon Appendix VI-2 and provide these to Buyer at least one-hundred and eighty (180) days prior to the Initial Delivery Date. The Parties shall finalize mutually acceptable Test Procedures at least thirty (30) days prior to the Initial Performance Test.
(vii) Following a Performance Test, Seller must deliver the Performance Test final results to Buyer no later than thirty (30) days after the completion of the Performance Test. Within ten (10) Business Days of receipt of the Performance Test results, Buyer must respond to Seller to either (A) accept those the results or (B) specify the reasons why the results cannot be accepted as submitted. Performance Test Procedures. Commissioning Agent shall prepare a Functional Test Plan for each system, assembly, and item of equipment being commissioned. Each Functional Test Plan shall provide a detailed description of the test procedures to be used to verify proper system/equipment operation.
Performance Test Procedures. Contractor shall develop the Performance Test Procedures (for both the Five Consecutive Day Operational Test and the Five Day Performance Ratio Test) in accordance with Exhibit H and shall provide the Performance Test Procedures for Owner’s review and approval, as soon as reasonably practicable after Contractor’s receipt of the Notice to Proceed (but in no event later than sixty (60) days prior to the commencement of the first Performance to be conducted by Contractor hereunder). Owner shall have thirty (30) days from the date it receives the Performance Test Procedures to review and provide comments to Contractor. Contractor shall incorporate all of Owner’s reasonable comments into the final Performance Test Procedures, which shall be approved by Owner (such approval not to be unreasonably withheld). If Owner fails to provide its comments within such Portions of this Exhibit, indicated by the xxxx “[***],” were omitted and have been filed separately with the Securities and Exchange Commission pursuant to the Registrant’s application requesting confidential treatment pursuant to Rule 24b-2 of the Securities Exchange Act of 1934, as amended. thirty (30) day period, then Owner shall be deemed to have approved the Performance Test Procedures. Contractor shall perform each Performance Test in accordance with the final approved Performance Test Procedures.
Performance Test Procedures. Contractor shall develop the Performance Test procedures consistent with its procedures for the Standard Plant and Contractor’s document APP-GW-T1R-600, (AP1000 Performance Test Requirements and Bases), as revised as of the Effective Date, and Contractor shall provide the Performance Test procedures to Owner at least one hundred and eighty (180) Days in advance of the Ready for Performance Test Date, which shall be subject to the Owner’s Acceptance, which Acceptance shall not be unreasonably withheld (the “Performance Test Procedures”). The Performance Test Procedures shall be sufficiently detailed for the Parties to conduct the Performance Tests in a manner that will demonstrate compliance with the Performance Guarantees, and shall include or reference the methodologies for calculating the test results, including the tolerances and correction curves to be applied to the test results. After the Performance Test Procedures have been Accepted by Owner, they shall not be revised without Owner’s prior written concurrence. The Documentation with respect to the performance of the tests and results of the tests shall be created and maintained by Contractor and delivered to Owner within fifteen (15) Days following Substantial Completion.
Performance Test Procedures. Contractor shall provide Owner, for Owner’s review and approval, detailed Performance Test Procedures and procedures for the start-up and commissioning of the Power Plant (each prepared in accordance with Exhibit “I”) not less than one hundred twenty (120) days prior to the date on which Contractor anticipates the commencement of the Performance Tests. Contractor and Owner shall cooperate reasonably to reach agreement on the Performance Test Procedures to be followed by Contractor not less than sixty (60) days prior to the date on which Contractor anticipates commencing the Performance Tests, and in any event prior to the start-up and commissioning of the Power Plant.
Performance Test Procedures. Contractor shall develop the Performance Test procedures consistent with its procedures for the Standard Plant and shall provide the Performance Test procedures to Owners at least one hundred and eighty (180) Days in advance of the testing and, in the case of any Site-specific matters or whenever required by Law, shall be subject to the Owners’ and/or Licensed Operator’s acceptance, which acceptance shall not be unreasonably withheld. The Performance Test procedures will be developed as part of the standard AP1000 Nuclear Power Plant procedures and test program. Therefore, any changes to these standard test procedures that Owners require that are not the result of a Contractor error or omission shall constitute a Change and shall entitle Contractor to seek a Change Order pursuant to Article 9. Documentation of the performance of the tests and results of the tests shall be created and maintained by Contractor and delivered to Owners as a condition of Final Completion.
Performance Test Procedures. No later than two hundred forty (240) Days prior to the Guaranteed Substantial Completion Date of Stage I, Contractor shall propose to Owner for its review and acceptance detailed final test procedures for the conduct of Performance Tests, and the functional tests as described in Appendix G, with respect to each Stage, including for Stage I, detailed final test procedures with respect to the LNG Tanks and the other Common Facilities; provided that Contractor shall endeavor to provide such test procedures no later than two hundred forty (240) Days prior to the Target Substantial Completion Date if earlier than the Guaranteed Substantial Completion Date. Contractor’s proposed test procedures shall incorporate all of the requirements and comply with the conditions of testing described in Appendix G. Once Owner has accepted final test procedures for the conduct of the Performance Tests and the functional tests described in Appendix G for such Stage (the “Performance Test Procedures”), the Performance Test Procedures shall form a part of the requirement for the conduct of the Performance Tests. Thereafter, either Party may propose changes to a Performance Test Procedure at any time up to sixty (60) Days prior to commencement of the initial functional test as described in Appendix G or the initial Performance Test, as applicable, and each Party agrees to cooperate in good faith in evaluating such change. No change shall be effective, however, without written acceptance of Owner and Contractor.
