Performance Testing Overview. Per Sections 1.1 and 1.2 below, Owner and the third party engineer retained by Owner (“Independent Engineer”) shall oversee a Five Consecutive Day Operational Test and a Five Day Performance Ratio Test (collectively, the “Performance Tests”) conducted by Contractor, which may be witnessed by Owner and the Independent Engineer, to demonstrate the reliability and performance of the Project. Contractor shall give Owner at least seven (7) days written notice in advance of the date on which Contractor intends to commence the initial Performance Test. Thereafter, Contractor shall give Owner at least three (3) days’ notice of all subsequent Performance Tests unless a shorter notice period is agreed to in advance and in writing by Owner.
