Common use of Performing Party’s Responsibilities for Subcontractors Clause in Contracts

Performing Party’s Responsibilities for Subcontractors. All acts and omissions of subcontractors, suppliers and other persons and organizations performing or furnishing any of the Scope of Work under a direct or indirect contract with Performing Party shall be considered to be the acts and omissions of Performing Party.

All work performed for Performing Party by a subcontractor must be pursuant to an appropriate written contract between Performing Party and the subcontractor and it must not be inconsistent with the terms of this Agreement.
