Perishable Goods. Goods of a perishable nature are carried in dry trailers without environmental or atmospheric control or other special services unless Shipper states on the face of the “Service Request and Shipping Instructions” that the goods are to be carried in a refrigerated, heated, specially ventilated or otherwise specially equipped trailer. This carriage may be subject to additional charges. Shipper is re- sponsible for bringing the goods to the proper temperature before loading the goods into the trailer, for the proper stowage of the goods within the trailer, and for setting the temperature (including maintenance and repair), during all times after the trailer is spotted by ▇▇▇▇▇▇▇ and before the trailer is received by ▇▇▇▇▇▇▇. ▇▇▇▇▇▇▇ is not responsible for product deterioration caused by inherent vice, defects in the merchandise or transit times in excess of product shelf life. Refrigerated, heated, specially ventilated or otherwise specially equipped trailers are not equipped to change the temperature of goods (they are equipped only to maintain temperature). Shipper will give written notice of requested temperature setting of the thermostatic controls before receipt of the goods by ▇▇▇▇▇▇▇. When a loaded trailer is received, ▇▇▇▇▇▇▇ will verify that the thermostatic controls are set to maintain trailer temperature as requested. ▇▇▇▇▇▇▇ is unable to determine whether the goods were at the proper temperature when they were loaded into the trailer or when the trailer is delivered to ▇▇▇▇▇▇▇. Air temperature at the unit sensor will be maintained within a proper range of plus or minus 5 degrees Fahrenheit of the temperature requested by Shipper on the face of the “Service Request and Shipping Instructions” if the goods were at that temperature when loaded into the container and if the temperature controls were properly set when the container was loaded.
Perishable Goods. If the Goods forming a Client Order are perishable or liable to deteriorate, MSL UK LTD has the right to sell or dispose of the Goods immediately upon the failure of the Client or its appointed agent to take delivery in accordance with the Client Order. However, MSL UK LTD will take reasonable steps to notify the Customer of its intention to sell or dispose of the Goods before doing so.

Perishable Goods. 1. With a view to preventing avoidable loss or deterioration of perishable goods, and provided all regulatory requirements have been met, each Party shall:
(a) provide for the release of perishable goods under normal circumstances within the shortest possible time; and
(b) provide for the release of perishable goods, in exceptional circumstances where it would be appropriate to do so, outside the business hours of its customs administration.
2. Each Party shall give appropriate priority to perishable goods when scheduling any examinations that may be required.
Perishable Goods. 17.1 Goods including but not limited to perishable goods in the care, custody or control of the Company may at the Customer’s expense be sold or disposed of by the Company without notice to the Customer, sender, Owner or consignee, if:
17.1.1 such Goods have begun to deteriorate or are likely to deteriorate, or are insufficiently addressed or marked; or
17.1.2 the Customer cannot be identified;
17.1.3 the Goods have not been collected or accepted by the Customer or any other person after the expiration of 7 days from the Company notifying the Customer in writing to collect or accept such Goods, provided that if the Company has no address for the Customer such notice period shall not be necessary, and payment or tender of the net proceeds, if any, of the sale thereof after deduction of those charges and expenses incurred by the Company in respect thereof shall be equivalent to delivery of such Goods.
17.2 Should any sum owing by the Customer to the Company become due and payable and remain unpaid, the Company shall be entitled, and the Customer hereby authorises the Company without further notice to the Customer and without first obtaining an order of court, to sell all or any of the Goods by public auction by private treaty. The net proceeds of any such sale, after deducting all costs, charges and expenses incurred by the Company, shall be applied in reduction or discharge as the case may be, of the Customer’s obligations to the Company in respect of such Goods, but without prejudice to the Company’s right to recover from the Customer any balance which may remain owing to the Company.

However, MSL UK LTD will take reasonable steps to notify the Customer of its intention before proceeding with the sale or disposal.

In the disputes related to perishable goods, the Parties and the panel referred to in Article XIII.07 shall do everything to accelerate the procedure to the maximum extent possible. For this purpose, the Parties shall try to reduce by mutual agreement the time frames established in this Chapter.
2. In cases of urgency, including those which concern perishable goods, consultations shall commence as soon as possible and no later than fifteen (15) days from the date of delivery of the request.

(a) provide for the release of perishable goods in the shortest possible time under normal circumstances;
(b) provide for the release of perishable goods outside the working hours of the customs authority and other competent authorities in exceptional circumstances where this is appropriate, in accordance with each Party's legal system;
(c) in the event of a significant delay in the release of perishable goods and upon written request, the importing Party shall, to the extent possible, provide a statement of the reasons for the delay; and
(d) allow an importer to have adequate facilities for the storage of perishable products pending their release. Each Party may require that any storage facilities provided by the importer have been approved or designated by the relevant authorities.

Each Party may require that any storage facilities arranged by the importer have been approved or designated by its relevant authorities. The movement of the goods to those storage facilities, including authorisations for the operator moving the goods, may be subject to the approval, where required, of the relevant authorities. Each Party shall, where practicable and consistent with its laws, on request of the importer, provide for any procedures necessary for release to take place at those storage facilities.
