Permanent Recruitment. 9.1 If at any time during the first 12 weeks of their placement the Agency worker applies for and is appointed to the same post to which they are on placement, the Authority shall pay to the service provider an agreed sum of money not exceeding the scale of rates detailed in the specification of service. For the avoidance of doubt no fee shall apply to any permanent recruitment of the agency worker to any post other than the post to which they have been placed. 9.2 The service provider shall advise the Authority prior to placement if the agency worker has a current application for permanent employment lodged with the Authority and should the agency worker be successful in their application, no fees shall be payable in accordance with Clause 9.1. 9.3 No fee shall apply to any permanent recruitment of an agency worker to any post after the first 12 weeks of placement.

An example of this would be when the Authority / Contract Participant have failed to obtain many CV’s from an advertisement. They may then request the Contractor to provide a list of suitable candidates to take on in the process.
