Common use of Permanent, variable hours Clause in Contracts

Permanent, variable hours. The hours worked by a permanent, variable hours employee may vary from time to time due to changes in circumstances surrounding the child or children to whom they provide support. a) Where the employer proposes to change an employee’s hours and/or days of work as specified in the appointment letter, the employer shall provide one month’s written notice (which may be by email) to the employee of any variation to their hours of work with reasons for the proposed change. b) Where the change involves either a reduction or an increase in hours and/or days of work, the employer shall consult with the employee to assess: • Whether the variation can be avoided or lessened • In the case of reduction in hours, whether that reduction can be absorbed by attrition • In the case of an increase in hours, whether that increase will create any difficulties for the employee • Whether other suitable work is available which shall be offered to the affected employee in the first instance c) The employee shall not unreasonably withhold agreement to vary their hours and/or days of work.
