Common use of Permitted Payments Clause in Contracts

Permitted Payments. Notwithstanding anything to the contrary contained in this Article 9, the holders of Securities may receive and retain at any time on or prior to the Maturity Date (a) securities that are subordinated to at least the same extent as the Securities to (i) Senior Debt and (ii) any securities issued in exchange for Senior Debt and (b) payments and other distributions made from any trust created pursuant to Section 11.01.

Permitted Payments. Notwithstanding anything to the contrary contained in this Article 9XIII, the holders of Securities may receive and retain at any time on or prior to the Maturity Date (ai) securities that are subordinated to at least the same extent as the Securities to (ia) Senior Debt and (iib) any securities issued in exchange for Senior Debt and (bii) payments and other distributions made from any trust created pursuant to Section 11.0114.01 hereof.

Notwithstanding anything to the contrary contained in this Article 9XI, the holders of Securities may receive and retain at any time on or prior to the Maturity Date (ai) securities that are subordinated to at least the same extent as the Securities to (ia) Senior Debt and (iib) any securities issued in exchange for Senior Debt and (bii) payments and other distributions made from any trust created pursuant to Section 11.018.01 hereof.

Notwithstanding anything to the contrary contained in this Article 9XI, the holders Holders of Securities may receive and retain at any time on or prior to the Maturity Date (ai) securities that are subordinated to at least the same extent as the Securities to (ia) Senior Debt and Designated Secured Indebtedness, (iib) any securities issued in exchange for Senior Debt Designated Secured Indebtedness, and (bc) shares of Common Stock, and (ii) payments and other distributions made from any trust created pursuant to Section 11.01SECTION 8.1.

Notwithstanding anything to the contrary contained in this Article 9ARTICLE XIII, the holders Holders of Securities may receive and retain at any time on or prior to the Stated Maturity Date (ai) securities that are subordinated to at least the same extent as the Securities to (ia) Senior Debt and (iib) any securities issued in exchange for Senior Debt and (bii) payments and other distributions made from any trust created pursuant to Section 11.0110.2.

Notwithstanding anything to the contrary contained in this Article 9XI, the holders Holders of Securities may receive and retain at any time on or prior to the Maturity Date (ai) securities that are subordinated to at least the same extent as the Securities to (ia) Senior Debt Secured Indebtedness, and (iib) any securities issued in exchange for Senior Debt Secured Indebtedness, and (bii) payments and other distributions made from any trust created pursuant to Section 11.01SECTION 8.1.

Notwithstanding anything to the contrary contained in this Article 9XII, the holders of Securities may receive and retain at any time on or prior to the Stated Maturity Date (a) securities that are subordinated to at least the same extent as the Securities to (i) Senior Debt and (ii) any securities issued in exchange for Senior Debt and (b) payments and other distributions made from any trust created pursuant to Section 11.0110.1.

Permitted Payments. Notwithstanding anything to the contrary contained in this Article 9V, the holders of Securities may receive and retain at any time on or prior to the Stated Maturity Date (ai) securities that are subordinated to at least the same extent as the Securities to (ia) Senior Debt and (iib) any securities issued in exchange for Senior Debt and (bii) payments and other distributions made from any trust created pursuant to Section 11.0110.2.

Permitted Payments. Notwithstanding anything to the contrary contained in this Article 911, in accordance with the terms of this Indenture, the holders Holders of Securities may receive and retain at any time on or prior to the Maturity Date (ai) securities that are subordinated to at least the same extent as the Securities to (ia) Senior Debt and (iib) any securities issued in exchange for Senior Debt and (bii) payments and other distributions made from any trust created pursuant to Section 11.018.01 hereof.
