Personally Identifiable Information means. 1. information concerning the individual that constitutes “nonpublic personal information” as defined in the Xxxxx-Xxxxx Xxxxxx Act of 1999, as amended, and regulations issued pursuant to the Act; 2. medical or xxxxx care information concerning the individual, including “protected health information” as defined in the Health Insurance Portability and Accountability Act of 1996, as amended, and regulations issued pursuant to the Act; 3. information concerning the individual that is defined as private personal information under statutes enacted to protect such information in foreign countries, for Claims subject to the law of such jurisdiction; 4. information concerning the individual that is defined as private personal information under a Breach Notice Law; 5. education records as defined by the Family Educational Rights and Privacy Act (FERPA), which are directly related to an individual’s attendance as a student;
