Phased Implementation. The Parties recognize and agree that implementation of the California HERO Program as a whole can and may be phased as additional other cities and counties execute similar agreements. City entering into this JPA Amendment will obtain the benefits of and incur the obligations imposed by this JPA Amendment in its jurisdictional area, irrespective of whether cities or counties enter into similar agreements.

Phased Implementation. The Purchaser may, in accordance with the terms of the PPA, undertake construction of the Power Station in phases as per details laid out at SCHEDULE VI. It is expressly clarified that a copy of all intimations/notifications provided by the Purchaser to the Utility under the PPA with regards to the phased implementation of the project shall be shared by the Purchaser with the Seller, within 7 (seven) days of issuance of such intimation/notifications by the Purchaser. Any failure in intimation may be treated as material breach of the agreement and dealt in accordance with relevant clauses of this Agreement.

Phased Implementation. Contractor shall perform a phased implementation that minimizes operational disruption and/or downtime and allows for the continuous operation of the current LAFD voice radio system while the new system is being installed. Contractor shall first install and configure one (1) channel at each of the nine (9) sites as a “proof of performance” for a minimum of thirty (30) days in operation prior to the installation and operation of the remaining channels. Contractor shall first install and configure all dispatch consoles located at the Operations Control Division (OCD) back-up dispatch center located at City Hall East P4 as a “proof of performance” for a minimum of thirty (30) days in operation prior to the installation and operation of the remaining consoles at Metro Fire Communications (MFC) dispatch center. Contractor shall ensure that during the phased implementation there is no interruption or other disruption to the audio recording of the existing telephone or radio systems as the new system is being installed. The City must accept the “proof-of-performance” test before proceeding with the rest of the installation.
