Common use of Physical Damage Insurance Clause in Contracts

Physical Damage Insurance. The Servicer shall, in accordance with its Customary Servicing Practices and only to the same extent, if any, that the Servicer so requires by obligors with respect to retail installment sales contracts that are held for the account of TMCC, require that each Obligor, upon the Servicer’s request, deliver proof that it has obtained physical damage insurance covering the related Financed Vehicle at the date of origination of the related Receivable, but shall not obtain any such coverage on behalf of any Obligor.

Physical Damage Insurance. The Servicer shall, in accordance with its Customary Servicing Practices and only to the same extent, if any, that the Servicer so requires by obligors with respect to retail installment sales contracts that are held for the account of TMCCcustomary servicing procedures, require that each Obligor, upon the Servicer’s request, deliver Obligor shall have delivered proof that it has obtained physical damage insurance covering the related Financed Vehicle at the date of origination of the related Receivable, but shall not obtain any such coverage on behalf of any Obligor. The Servicer shall be required to monitor the maintenance by any Obligor of such insurance only to the same extent, if any, that the Servicer monitors such maintenance by obligors with respect to retail automobile sales contracts that are held for the account of TMCC.
