Common use of Pipelines; Rights of Way Clause in Contracts

Pipelines; Rights of Way. If at any time the Tenant notifies the Landlord that the Facilities require an off-Site pipeline and/or pipeline servitude for the development, construction or operation of the Facilities at the Site, the Landlord shall, with respect to its own real (immovable) property, grant and, with respect to any other property, use commercially reasonable efforts to cause the applicable landowners and Governmental Authorities to grant, the pertinent approvals to achieve, site, construct and operate and maintain the pipeline and/or pipeline right of way, as directed and on such terms and conditions as reasonably requested by the Tenant.

The Landlord shall not be required to incur any costs or expenses in its efforts to assist the Tenant.
