Common use of Place of Repair Clause in Contracts

Place of Repair. During the Warranty Period, ORBCOMM shall have the option to repair the defective goods on-site or, if feasible, require that the goods be returned to its or its designee's facilities; provided that all shipping and insurance costs associated with shipment of defective goods to ORBCOMM's designated repair facility shall be paid by Licensee and all shipping and insurance costs associated with return shipment of repaired goods shall be paid by ORBCOMM; and provided further, that items found not to be defective shall be returned at Licensee's expense.
