Common use of PLACEMENT AND PERFORMANCE Clause in Contracts

PLACEMENT AND PERFORMANCE. 21.1. If at any time during the currency of this Agreement, the CARRIER fails to provide vehicles for transportation within the specified time as directed by ISRPL or fails to transport the goods within the period as stipulated or fails to perform any other obligation specified in this Agreement, ISRPL in its discretion and without prejudice to it’s other rights and remedies may obtain services from other CARRIERS to perform the obligations of the defaulting CARRIER and transport the goods at risk and cost of the defaulting CARRIER. The CARRIER at default undertakes to reimburse to ISRPL all expenses incurred by ISRPL in this connection. ISRPL will also have the right to recover the losses from the CARRIER, which it suffers due to non-placement of vehicles in time, by the defaulting CARRIER.
