The "Plan Materials" clause defines the ownership, use, and handling of documents, drawings, specifications, and other materials created or used in connection with a project plan. Typically, this clause clarifies whether such materials remain the property of the party that created them or are transferred to the client upon completion, and may address issues like confidentiality, permitted uses, or requirements for returning or destroying materials after the project ends. Its core function is to prevent disputes over intellectual property and ensure both parties understand their rights and obligations regarding the materials generated during the planning process.
Plan Materials. Upon termination, Empower shall provide the successor service provider with copies of all Plan summaries, Participant statements and other forms, reports, or web content; provided, however, Empower will provide such Plan materials only to the extent designed specifically for the Plan and not deemed by Empower to be proprietary. In addition Plan Administrator agrees, and will require any third party to whom Plan Administrator provides the materials to agree, to maintain the confidentiality of all Empower materials and information, including but not limited to web content, communications material, and information on Empower’s Plan Sponsor Website.
Plan Materials. Stormwater management plans shall satisfy all of the requirements in Subsection (B), and shall provide at a minimum the following information unless waived by the Village Administrative Authority: (1) A narrative describing the proposed project, including an implementation schedule for the planned practices. (2) Identification of the entity responsible for long- term maintenance of the project. (3) A map showing the drainage areas for each project site under pre-development land conditions and a map showing the drainage areas for each project site under post- development land conditions. (4) A summary of runoff peak flow rate calculations, by watershed area, including: (a) Pre-development peak flow rates and durations for the required design storms; (b) Post-construction peak flow rates and durations with no detention for the required design storms; (c) Post-construction peak flow rates and durations with detention for the required design storms; (d) Assumed runoff curve numbers (RCNs) for pre- development and post-development conditions; and (e) Time of concentration (Tc) used in calculations. (5) Details and calculations indicating how the infiltration standards are to be met. (6) Details and calculations indicating how the water quality standards are to be met. (7) A completed site plan and specifications, signed by the person who designed the plan. All plans shall be drawn to an easily legible scale, shall be clearly labeled, and shall include, at a minimum, all of the following information unless waived by the Village Administrative Authority: (a) Property lines and lot dimensions; (b) All buildings and outdoor uses, existing and proposed, including all dimensions and setbacks; (c) All public and private roads, interior roads, driveways and parking lots. The traffic patterns and type of paving and surfacing material shall also be shown; (d) All natural and artificial water features, including, but not limited to, lakes, ponds, streams (including intermittent streams), creeks, and ditches. The ordinary high water marks of all navigable waters, the 100-year flood elevations, and the delineated wetland boundaries, if any, shall be shown. If not available, an appropriate flood zone determination or wetland delineation, or both, shall be prepared by the applicant at his or her expense; (e) Depth to bedrock; (f) Depth to seasonal high water table; (g) The extent and location of all soil types as described in the La Crosse County Soil Survey, slopes exceedin...
Plan Materials. The Contractor shall provide all marketing, promotional, educational, or any other materials, or written communication related to the Plan, to the Department for review and written approval prior to its use and dissemination. The Department shall be provided the opportunity to customize all such communications. The final materials used by the Contractor must not differ in form or utility from those approved by the Department. The Contractor shall be responsible for the development of Plan benefit information including but not limited to 1) open enrollment brochures and promotional pieces and 2) other Plan-related printed materials (e.g., Summary Plan Description, ID cards and benefit brochures). The Contractor shall also meet the following requirements: a. Be responsible for writing, printing, and distributing (electronically or by mail as required) Plan materials. b. Provide, upon request of the Participant, printed materials in a medium widely accepted for the hearing and/or visually impaired. c. Provide all printed material in electronic format with final versions submitted to the Department in PDF file format. Contractor shall provide Participants with ID cards either as a new Participant or when there are changes in the card’s elements, at no additional cost to the Participants or the Department. The design of the ID card is subject to the approval of and customization by the Department. The Contractor shall also: a. Mail one (1) ID card for each Enrollee and at least one (1) additional ID card for Enrollees with multiple Participants. b. Provide additional ID cards upon request of a Participant. c. Assign a unique Member ID number and will print the number on each ID card. The Participant's SSN will never be printed on the ID card. d. Mail ID cards, including those mailed in the Fall of 2022 for the 2023 coverage year, annual Open Enrollment periods and otherwise as required due to Plan or law changes, in accordance with PG-5 and PG-6 of Attachment 3: Performance Guarantees, of the Contract.
Plan Materials. Draft copies of all sales literature, Prospectuses, printed matter and other material which contain any references to the Custodian, except material which is merely circulated among or sent to employees, stockholders or representatives of the Sponsor and correspondence in the ordinary course of business which refers in accurate terms to the Custodian's functions under the Plans.
