Common use of Planning Approvals Clause in Contracts

Planning Approvals. The Developer acknowledges that the Development requires approvals and entitlements from the County, including a General Plan amendment (together, such approvals and entitlements are the "Planning Approvals"). During the Negotiating Period, the Developer shall submit conceptual site plans and preliminary designs for the Development to the appropriate County departments for their informal review. During the Negotiation Period, County, at its sole cost and expense, will process the General Plan Amendment and assist Developer with any other zoning issues. Except with respect to the General Plan Amendment, the Developer shall submit applications for those components, if any, of the Planning Approvals that are required to be submitted in accordance with the schedule of performance described in Section 10 below.
