Pooling and Servicing Agreement. IXIS hereby agrees that, notwithstanding any provision of this agreement to the contrary, Counterparty’s obligations to pay any amounts owing under this Agreement shall be subject to Section 3.20(b) of the Pooling and Servicing Agreement and IXIS’s right to receive payment of such amounts shall be subject to Section 3.20(b) of the Pooling and Servicing Agreement.
