Portfolio Performance Data Clause Samples
The Portfolio Performance Data clause defines the requirements and procedures for providing information about the performance of a portfolio, such as investment returns, benchmarks, or other relevant metrics. Portfolio Performance Data. On the first Reporting Date of each calendar month, Seller will furnish to Buyer (i) in the event the Mortgage Loans are serviced on a “retained” basis, an electronic Mortgage Loan performance data, including, without limitation, delinquency reports and volume information, broken down by product (i.e., delinquency, foreclosure and net charge-off reports) and (ii) electronically, in a format mutually acceptable to Buyer and Seller, servicing information, including, without limitation, those fields reasonably requested by Buyer from time to time, on a loan-by-loan basis and in the aggregate, with respect to the Purchased Mortgage Loans serviced by Seller or any Servicer for the month (or any portion thereof) prior to the Reporting Date. In addition to the foregoing information on each Reporting Date, Seller will furnish to Buyer such information upon (i) the occurrence and continuation of an Event of Default and (ii) upon any Purchased Mortgage Loan becoming an Aged Loan.

In addition to the foregoing information on each Reporting Date, Seller will furnish to Buyer such information upon (i) the occurrence and continuation of an Event of Default and (ii) upon any Purchased Mortgage Loan becoming an Aged Loan.

In addition to the foregoing information on each Reporting Date, Seller will furnish to Administrative Agent such information upon (i) the occurrence and continuation of an Event of Default and (ii) upon any Transaction Mortgage Loan becoming an Aged Loan.

On or prior to each Reporting Date, Sellers shall furnish to Buyer (i) electronic Mortgage Loan performance data, including, without limitation, delinquency reports and volume information, broken down by product (i.e., delinquency, foreclosure and net charge-off reports) and (ii) for Mortgage Loans serviced by a Subservicer, electronically, in a format mutually acceptable to Buyer and Sellers, servicing information, including, without limitation, the Current Property Value, on an asset-by-asset basis and in the aggregate, with respect to the Mortgage Loans serviced by Sellers, any Subservicer (or any portion thereof) prior to the Reporting Date.

On the first Reporting Date of each calendar month, Sellers will furnish to Administrative Agent (i) in the event the Seasoned Mortgage Loans are serviced on a “retained” basis, an electronic Purchased Mortgage Loan and Contributed Asset performance data for Seasoned Mortgage Loans, including, without limitation, delinquency reports and volume information, broken down by product (i.e., delinquency, foreclosure and net charge-off reports) and (ii) electronically, in a format mutually acceptable to Administrative Agent and Sellers, servicing information, including, without limitation, those fields reasonably requested by Administrative Agent from time to time, on a loan-by-loan basis and in the aggregate, with respect to the Purchased Mortgage Loans serviced by any Seller or any Servicer for the month (or any portion thereof) prior to the Reporting Date and, with respect to Seasoned Mortgage Loans and Contributed Assets, the current BPO and the current BPO date. In addition to the foregoing information on each Reporting Date, Sellers will furnish to Administrative Agent such information upon (i) the occurrence and continuation of an Event of Default and (ii) upon any Purchased Mortgage Loan becoming an Aged Loan.

On the first Weekly Report Date of each calendar month, Borrower will furnish to Lender electronically, in a format mutually acceptable to Lender and Borrower, servicing information, including, without limitation, those fields reasonably requested by Lender from time to time, on a loan-by-loan basis and in the aggregate, with respect to the Mortgage Loans serviced by Borrower for the month (or any portion thereof) prior to the Weekly Report Date.
Portfolio Performance Data. On or prior to each Reporting Date, Seller shall furnish or cause to be furnished to Buyer and the Paying Agent for each Trust Mortgage Loan and REO Property (i) electronic Trust Mortgage Loan and REO Property performance data, including, without limitation, Income received, delinquency reports and volume information, broken down by product (i.e., delinquency, foreclosure and net charge-off reports), (ii) electronically, in a format mutually acceptable to Buyer and Seller, servicing information, including, without limitation, the Current Property Value, on an asset-by-asset basis and in the aggregate, with respect to the Trust Mortgage Loans and the REO Properties serviced by Seller, a Servicer or the Asset Manager for the month (or any portion thereof) prior to the Reporting Date and (iii) data relating to all Servicing Advances made during the month prior to the Reporting Date, including type and amount of such Servicing Advances. In addition to the foregoing information on each Reporting Date, Seller will furnish to Buyer such information upon (i) the occurrence and continuation of an Event of Default and (ii) any Trust Mortgage Loan being modified.
Portfolio Performance Data. On or prior to each Reporting Date, each Seller will furnish to Administrative Agent (x) electronic Contributed Mortgage Loan and Contributed REO Property performance data, including, without limitation, delinquency reports and volume information, broken down by product (i.e., delinquency, foreclosure and net charge-off reports) and (y) for Mortgage Loans and REO Properties serviced by Servicer, electronically, in a format mutually acceptable to Administrative Agent and such Seller, servicing information, including, without limitation, the current BPO, on an asset-by-asset basis and in the aggregate, with respect to the Contributed Mortgage Loans and the Contributed REO Properties serviced by such Seller or any Servicer for the month (or any portion thereof) prior to the Reporting Date. In addition to the foregoing information on each Reporting Date, each Seller will furnish to Administrative Agent such information upon the occurrence and continuation of an Event of Default.
Portfolio Performance Data. At the ▇▇▇▇ ▇▇▇▇▇▇ furnishes each set of financial statements pursuant to Section 17.a(1), (2) and (3) above, Seller will furnish to Administrative Agent (i) in the event the Mortgage Loans are serviced on a “retained” basis, an electronic Mortgage Loan performance data, including, without limitation, delinquency reports and volume information, broken down by product (i.e., delinquency, foreclosure and net charge-off reports) and (ii) electronically, in a format mutually acceptable to Administrative Agent and Seller, servicing information, including, without limitation, those fields reasonably requested by Administrative Agent from time to time, on a loan-by-loan basis and in the aggregate, with respect to the Mortgage Loans serviced by Seller for the calendar month corresponding to the financial statements being delivered including, with respect to a GNMA EBO, the current BPO and the current BPO date.
