Common use of Possession of Firearms Clause in Contracts

Possession of Firearms. In accordance with §790.115 Florida Statutes, the possession of firearms will not be tolerated on School District property. No person, who has a firearm in their vehicle, may park their vehicle on the Owner’s property. Furthermore, no person may possess or bring a firearm on the Owner’s property. If any employee/independent contractor of the Construction Manager, or any of its sub-contractors, is found to have brought a firearm(s) on to the Owner’s property, said employee/ independent contractor of the Construction Manager shall be immediately removed and terminated from the project by the Construction Manager. If sub-contractor fails to terminate said employee/ independent contractor of the Construction Manager, the Construction Manager shall terminate its agreement with the sub-contractor. If the Construction Manager fails to terminate said employee/ independent contractor of the Construction Manager or fails to terminate the agreement with sub-contractor who fails to terminate said employee/ independent contractor of the Construction Manager, the Owner may terminate this Agreement. “Firearm” means any weapon (including a starter gun or antique firearm) which will, is designed to, or may readily be converted to expel a projectile by the action of an explosive; the frame or receiver of any such weapon; any destructive devise, or any machine gun. Powder-actuated construction nailers and fasteners are excluded from this definition.
