Common use of POST-RESERVE CREATION AGREEMENTS Clause in Contracts

POST-RESERVE CREATION AGREEMENTS. The Band agrees that where Saskatchewan requires additional Land or interests in Land for the purpose of constructing, maintaining or upgrading a Provincial Road or Provincial Highway for use by the general public which is located: (a) immediately adjacent to an Undeveloped Road Allowance in respect of which Saskatchewan has requested the return to its administration and control in accordance with this Article 7; or (b) within an Entitlement Reserve which is located adjacent to a Provincial Road or Provincial Highway which has not been transferred to Canada under an agreement contemplated by this Article 7; (c) within an Entitlement Reserve in the unsurveyed portion of the Province; the Band agrees to give favourable consideration to making such Land, or interests in Land, available to Saskatchewan and, if the same is made available, to promptly provide the Band's consent in writing as may be required pursuant to applicable federal legislation to permit Canada to transfer the Land or any interest therein to Saskatchewan, subject to reversion where required, upon the payment of compensation at fair market value to be paid to Canada for the use and benefit of the Band.
