Postponement or Cancellation. If Organization postpones or cancels any Assessment within 21 days from the first day of the agreed assessment date, PJRFSI will charge a fee equal to the greater of 50% of the quoted Assessment Fee, or one day at the per-day rate applicable at that time, PLUS the cost, at the prevailing per-day rate, of any work performed to date, PLUS any non-recoverable travel and lodging expenses incurred. These charges are not credited against any subsequent charges incurred by Organization. In an emergency situation, Organization may request and PJRFSI may waive these charges, in PJRFSI’s sole and absolute discretion. The President of PJRFSI prior to the first day of the originally scheduled audit dates must sign such a waiver.
Postponement or Cancellation. (a) When a postponement is made prior to the day of the event, employees shall not be entitled to any remuneration for that day unless they have been required to travel prior to the postponement.
(b) When a postponement takes place on the day of the event and prior to the normal starting time, half rates shall be paid, provided however, that when the event has been scheduled to be held at night the rates mentioned herein shall be payable only when the postponement takes place after 3pm and prior to the normal starting time on the day of the event.
(c) Postponements prior to the day of the event will be notified by an announcement on the appropriate radio station at 7pm or thereabouts on the evening prior.
(d) Postponements made on the day of the event will be announced on the appropriate radio station at 6am or thereabouts.
Postponement or Cancellation. If only one party requests the postponement or cancellation of an arbitration hearing, that party shall bear the full cost of such postponement or cancellation.
Postponement or Cancellation. The Cure Starts Now and Brew- Ha- Ha shall not be liable for any damages or expenses incurred by Exhibitors if the event rented space cannot be occupied; the festival is delayed, interrupted, or not held as scheduled for any reason beyond reasonable control of The Cure Starts Now and Brew- Ha- Ha. The Cure Starts Now and Brew- Ha- Ha may retain as much of the amount paid by Exhibitors as is deemed necessary to defray expenses already incurred by The Cure Starts Now and Brew- Ha- Ha. The event will be held rain or shine. If Exhibitor fails to occupy rented space by 2:00PM or fails to comply in any other respect with the terms of this agreement The Cure Starts Now and Brew- Ha- Ha shall have the right to use such space. No refunds will be made if space or portion of space is not used.
Postponement or Cancellation. 17.1 In the event: (a) a physician licensed by the Nevada State Athletic Commission certifies that Tyson or his opponent is temporarily mentally or physically disabled to such an extent that he cannot participate in any Event as scheduled, (b) any Event is delayed or temporarily prevented from occurring on the scheduled date by reason of an Act of God, fire, flood, storm, war, public disaster, or any governmental or regulatory or boxing or athletic commission or association enactment, determination or action, regulation or order ("Force Majeure Event"), or (c) the Grand Garden is materially damaged by a Force Majeure Event, or Subsidiary's performance of this Agreement is prevented or materially frustrated by a Force Majeure Event or any other cause beyond Subsidiary's reasonable control, (d) if any Fighter Participant shall fail or refuse to participate in the Event for any reason (other than a breach of this Agreement or in the case of Tyson, death or insurable permanent mental or physical disability), or (e) the live telecast of the Event shall be prevented for any reason beyond the reasonable control of Promoter, then Promoter shall reschedule the Event to a date and time reasonably acceptable to Subsidiary within sixty (60) days and, this Agreement shall apply to the rescheduled Event. Any postponement under this Section shall extend the Maturity Date for a like period of time.
17.2 If any Event shall not be conducted on the scheduled date (or rescheduled date under Section 17.1), by reason of the breach of this Agreement by Subsidiary or Promoter, then the injured party shall have available all of the remedies allowed by law or equity. Subsidiary and Promoter acknowledge that the rights granted under this Agreement are personal, valuable and unique, such that a breach of any of the material provisions of this Agreement will cause irreparable harm which cannot be adequately compensated merely by monetary damages. The injured party shall be entitled to equitable relief, including specific performance of this Agreement and preliminary and permanent injunction relief.
Postponement or Cancellation. Either party may request postponement or cancellation of a scheduled hearing date, and such postponement or cancellation may be made by mutual agreement of the parties. Any fees or expenses of the arbitrator associated with such postponement or cancellation shall be borne by the party initiating the request.

If any day of a 2024 STARS Series Event (Race Day) is postponed or canceled for any reason (which decision shall be made in STARS sole discretion), STARS may reschedule the Race Day and Team will participate in such rescheduled Race Day as though it were the originally scheduled Race Day. In the event that a Race Day(s) is postponed or canceled for any reason and STARS is not able to reschedule the event, then Team shall not be entitled to any Winner’s Circle for the originally scheduled Race Day. Should a Race Day be rescheduled and cause a Team to return to such facility at a later date, Team shall be entitled to Winner’s Circle for the rescheduled Race Day only.
