Potential Abandonment of Rights by BMI. In the event that registration and commercialisation of Licensed Product under Section 3.2 is not consistent with good business judgment in any country of the Territory, then such country shall be deleted from the Territory and BII shall be entitled to make use in such country of any data generated by BMI under such terms as are agreed by BII and BMI taking into account the costs incurred by BMI generating such data and the sales potential in such country.
