Common use of Power of Trustee to Enforce Clause in Contracts

Power of Trustee to Enforce. All rights of action under this Master Indenture or under any of the Bonds secured by it which are enforceable by the Trustee may be enforced without the possession of any of the Bonds, or their production at the trial or other related proceedings. Any suit, action or proceedings instituted by the Trustee may be brought in its own name, as trustee, for the equal and ratable benefit of the Owners subject to the provisions of this Master Indenture.

Power of Trustee to Enforce. All rights of action under this Master Indenture or under any of the Bonds secured by it which are enforceable or otherwise may be prosecuted and enforced by the Trustee may be enforced without the possession of any of the BondsBonds or the production thereof in any proceeding relating thereto, or their production at the trial or other related proceedings. Any and any such suit, action or proceedings proceeding instituted by the Trustee may shall be brought in its own name, as trustee, the name of the Trustee for the equal benefit and ratable benefit protection of the Owners of such Bonds, subject to the provisions of this Master Indenture.
