Practice Responsibility. PRACTICE Physicians are solely responsible for provision of all health care services to Members. All decisions regarding Member treatment and care are the responsibility of PRACTICE Physicians and such decisions are neither directed nor controlled by HMO. And, except as to the amount and manner of payment specified in this Agreement, this Agreement shall in no way affect the usual physician/patient relationship. The PRACTICE and PRACTICE Providers shall provide services to Members in the same manner and quality as those services that are provided to other patients of the PRACTICE/PRACTICE Provider that are not HMO Members. The PRACTICE Providers and/or PRACTICE shall: 1. Provide all necessary professional and ancillary services to Members enrolled with the PRACTICE as described in the HMO Provider Manual and the HMO Medicaid Plan Certificate of Health Care Benefits. 2. Upon notification, cooperate with HMO with directing and managing necessary professional and ancillary services for admissions. 3. Ensure that PRACTICE Providers will provide or coordinate, direct and manage all: a) Covered Services regardless of whether HMO is the primary insurer b) Covered Services related to mental health 4. Except in the case of a medical emergency, PRACTICE agrees to refer or admit Members for Covered Services to Providers designated, approved by or under contract with HMO. a) Ensure appropriate use of the HMO Participating Provider network which is made available to PRACTICE by HMO on the HMO provider portal: 5. Cooperate with HMO, to assist a Member who is receiving services from a Non- Participating Provider to return to a Participating Provider when medically appropriate. 6. Assure that all PRACTICE Physicians inform the Member of treatment options. 7. Assure that all PRACTICE Physicians maintain a daily appointment log. 8. Not subcontract or delegate its medical duties hereunder without prior approval of the HMO, except by normal referral of Members to specialists outside the PRACTICE. 9. Practice Responsibility. Practice acknowledges that it is solely responsible for inputting and retrieving Practice Information into and from the Database. PRACTICE ACKNOWLEDGES THAT IT SHALL HAVE FULL AND SOLE RESPONSIBILITY FOR THE CARE THAT IT PROVIDES TO ITS PATIENTS AND ANY RELIANCE BY PRACTICE UPON THE APPLICATION AND SERVICES SHALL NOT DIMINISH, TRANSFER OR ALTER SUCH RESPONSIBILITY.
