Common use of Pre-Change in Control Termination Clause in Contracts

Pre-Change in Control Termination. Nothwithstanding any other provisions of this Agreement, if the requirements of Section 1(e) are met regarding the Executive’s termination prior to a Change in Control, the Change in Control Benefits shall be paid on the 60th day following the date of the Change in Control (not the Date of Termination). The Release called for in Section 4(b) shall not be required.
